If you are suffering from injuries, it is within your right to sue for compensation under a personal injury claim. In addition, if you have lost a loved one in an accident due to negligence, you can file a wrongful death suit. If you are unsure whether you are justified to sue, contact our office for a free consultation session.

The process must be right from the word go to file for a successful car accident claim. So how do you file a car accident claim?

Steps for Filing a Car Accident Claim

Contact the Police

Immediately after you are involved in a car accident, the first thing you need to do is call the police. If there are injured pedestrians or drivers, call an ambulance.

There are two main reasons why you need to call the police. The first is that some insurance companies will require a police report so that they can start the compensation process. The second reason is that a police report is an official recollection of the scene of an accident, and it will help with your lawsuit. Furthermore, contacting the police to the scene of an accident is a law in many states.

Document the Scene of the Crash

If you are not seriously injured, it is advisable to document the crash scene. Some of the things that you should do after a car accident are as follows:

  • Take photos of the crash scene
  • Record details of the crash
  • Log the time, date, and location of the accident
  • Exchange eye witness information
  • Get information about the other driver, including insurance details
  • Seek medical attention

Give Us a Call

After you have gone to the hospital, you should immediately call us and share the information you have collected. We will review the information, determine fault, and directly build a case. One aspect of building a solid case is examining your medical records and seeking expert opinions based on your injuries.

If your income has been affected, we will use experts to determine how much you should be compensated.

Sending a Demand Letter

Once we have a solid case, we will send a demand letter to the other party’s insurance company demanding a settlement. The demand letter will contain information about the accident, the severity of the injury, the medical treatment, and why the other driver is liable.

After we send the demand letter, the insurance company will conduct their investigation, and they have a right to accept or reject the demanded settlement. In Texas, the compensation should be accepted or denied within 45 days.

Call a Reputable Car Accident Attorney

If the Insurance company does not want to pay or they are undervaluing your settlement, we will go to court. We have years of experience defending car accident victims. Therefore, you can rest assured that the best possible outcome for your case will be achieved.
